The author has right of exploitation of work personally as well as right of transfer (to assign or grant the right of temporary exploitation) of his economic rights to other persons. The transfer of rights is exercised under the contract on transfer of copyright, or under the licensing contract (the transfer of right of work's exploitation).
Under the contract on transfer (assignment) of copyright the author assigns all of his exclusive economic rights for the whole term of their validity, under the payment of certain remuneration. Accordingly, the author loses his or her economic rights. The moral rights, however, vest in the author, and due to their nature are inalienable.
The Contract on transfer of rights provides for the transfer of economic rights in whole or in part, to other person for the certain period of time and under the certain conditions.
The contracts mentioned above, are concluded under the mutual consent of both of the parties. Nevertheless, they shall include a number of mandatory provisions, as set up by the relevant laws.
The Copyright related contratcs come in force from the moment of their signature by the parties. The notarization or registration at the relevant authorities, is not required. Nevertheless, the law of Ukraine "On Copyright and Related Rights" provides for the volunrtary registration procedure of such types of contracts. The registration is exercised at the parties' wish.
The registration of contracts is administered by the State Department of Intellectual Property. The contract shall be submitted for the registration by the natural or legal person -rightholder, his or her successor in title, or his or her authorized representative. Thereby the parties shall submitt the additional copy of the contract, to be filed at the State Department.
The Contract's registration procedure takes around 2 months. Upon the registration the contract' details are being included in the State Registry, and published in official bulletin of the State Department. The applicant receives the relevant certificate.
