Accelerated Trademark Examination Procedure

This procedure is required in case of the following circumstances:

• During the term of pending registration the owner gets to know about the facts of his rights’ violation. He therefore is determined to bring an action aimed at protection of his rights (i.e. filing the siot at the court);
• The owner plans to conclude the contract on the transfer of rights or the contract on teh exploitation of rights on trademark, with other natural/legal person;
• The owner is interested in obtaining the 2nd level’ domain name in zone .UA ;
• The owner wants to accelerate the procedure of issue of the trademark regitration certificate for the purpose of advertizing, image –making or other.

The term of issue of the registration certificate under the accelerated procedure is 8-9 months. Such term is calculated with due account for the following factors:

• Upon the request filed under the relevant International agreements that are mandatory for Ukraine, the ytademark registration claims can not be processed earlier than in 6 moths from the date of filing of such claim. Thereofre, the application for the accelerated procedure can be filed only 6 moths after the filing of the registration claim;
• The term of the accelerated procedure is 1 month from the date of the respective application;
• The term of issue of the trademark registration certificate depends on the fact of publication of the respective information in the official bulletin “Intellectual Property”. The bulletin is published on the monthly basis. The information on the registration claim is to be prepared and presented for publishing 1 month prior to signing the bulletin for publishing. Therefore, the term of issue of the registration certificate is from 1 to 3 motnhs. At the moment no accelerated procedure for the publication of the registration claim exists.
